The Committee to Recall Senator Robert Menendez Files State Supreme Court Brief
APRIL22, 2010, BRANCHVILLE, NJ—The Committee to Recall Senator Robert Menendez is filing its response today to Senator Menendez's request to the New Jersey Supreme Court to hear his appeal protesting the Senator’s recent loss in the Appellate Court.
Andy Schlafly, lead counsel for the Committee to Recall Senator Robert Menendez, said he had high confidence in the merits of the case.
On March 16, 2010, Appellate Court Judges Edwin Stern, Robert Graves, and Jack Sabatino, ruled 3-0 in favor of the Committee.
“Those three fine constitutional lawyers in black robes found that according to the state constitution, the Committee had the right to recall a United States Senator. The unanimous ruling speaks to the clarity of the law,” Schlafly said.
If successful at the State Supreme Court, the Committee will need 1.3 million signatures to force the recall of Senator Menendez. RoseAnn Salanitri, chair of the 527 watchdog corporation Recall NJ (RecallNJ.com), was confident that the organization could collect those signatures. “Our movement is growing, and the opposition to the irresponsible $14 trillion deficit spending binge of Menendez and his fellow liberals in Congress—in one year!—and to the clearly unconstitutional Obamacare disaster is building to a crescendo. People are signing up on our website: RecallNJ.com on a daily basis,” Salanitri said.
